Portrait Sessions Agreement & Booking Form

AGREEMENT OVERVIEW: In the following conditions of the contract Lesanie Images, LLC shall mean Lesanie Images, Photographer, and any photographer appointed to work for the photography session. The Client(s)’ shall be those whose names appear on the booking form/contract. If the Clients arrange for a third party to meet the cost of this contract the contract remains with the Clients. The due performance of the contract is subject to the conditions below and cannot be varied in any way by the Clients unless expressly agreed by Lesanie Images in writing.

BOOKING PROCESS & SESSION FEE PAYMENT TERMS: The NON-REFUNDABLE SESSION FEE is due at the time of booking and is required to reserve the photographer's time and talent. All payments are non-refundable and deemed fully earned when paid. Time slots are confirmed when payment is sent and the signed contract is received. Bookings without a non-refundable payment and a signed contract are not secured and your session may be lost. Upon booking your session, Lesanie Images will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all payments are non-refundable even if the date and time are changed or if the Client cancels the contract. Acceptable payment is by credit/debit card, Zelle, PayPal, or cash only unless approved by Lesanie Images. Prints, albums, additional digital files, art pieces, and other custom products are available to invest in separately after the session. The session date and time are not officially reserved until both payment and contract are received.

COVERAGE: Lesanie Images will provide coverage for the dates, locations, and continuous hours specified in this contract. The time spent by the photographers does not pause or extend the total continuous hours included in Client’s package. Time spent in travel from one location to another and time spent eating meals does not stop, pause or extend the total continuous hours.

APPEARANCE/RE-SHOOTS/CLIENT REGRET: In the event that the Client would like additional photos due to appearance out of the Photographer's control (clothing/hair/makeup, etc.) in the previous session, the Client will be charged for an additional session at the Photographer’s hourly rate to reschedule or shoot additional photos. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair, or weather-related issues, or for not following the recommendations of the Photographer. Photographer does not offer free or discounted re-shoots on the basis of Client regret over wardrobe choice, location choice, etc. Clothing, hair, or make-up is a personal choice, and the Client may retain their own stylist or make-up artist on location at the client’s cost to ensure they are satisfied with their appearance prior to and during the photo session.

LOCATION(S): If the Client has more than one location for the session, the travel time going from destination 1 to destination 2 and so forth does count towards the total amount of the session time. 

LOCATION ACCESS, FEES, PERMITS AND HOUSE RULES: If the Client chooses to shoot at a location that charges for access or requires permits, they shall be responsible for all fees associated with shooting there, including but not limited to entrance fees and parking. The Client shall also be responsible for organizing access to the location and any permits required for doing so. In the event that the Client specifies a certain shoot location, that is not at Broughton Beach in Little London, the Client is also responsible for paying the travel fees for Lesanie Images to perform the Service the Client requests. The Photographer will not guarantee or arrange payment at any location. The Clients agree and understand that Lesanie Images is limited by the guidelines of the location site/venue management/government rules and clients agree to accept the results that may occur from said guidelines. Negotiation with the officials/management for the moderation of guidelines is solely the Client's responsibility. If the Client appears under the influence of alcohol or drugs during the shoot, Lesanie Images has the right to cancel the shoot immediately due to public liability and health and safety concerns.

ADDITIONAL FEES: There are additional fees for the following: added time, additional outfit changes, or any products/prints/services not specified in the package purchased. Payment must be made before any additional shooting occurs or any images/prints/products are handed over to the Client.

1. In the event that the Client wants to add additional time, they will be charged $200 USD per hour or part thereof.
2. In the event that the Client wants to add additional persons/family members to their shoot, they will be charged $50 USD per person to add them into the session, instead of the full amount for a session.
3. Outfits: Although there are no additional fees for additional outfits, the amount of time it takes to change into those outfits does count towards the total amount of the session time. 
4. Basic editing is included in the session package at no additional cost. More involved requests are billed at $100 USD per image. The Client will be asked to confirm the additional rate before work is begun.

SESSION RESCHEDULING: If a Client wishes to reschedule their portrait session it must be done via email and acknowledged by Lesanie Images 48 hours prior to the session date. If the Client is unable to make it to the photo session all payments made will act as a cancellation fee. If the Client wishes to reschedule they will have 30 days from the original session date before the session expires. In the event of an expired session or cancellation, the Client will not receive any type of refund or credit for future services with Lesanie Images. At the discretion of Lesanie Images, the Client may be invoiced a $75 rescheduling fee. The photographer reserves the right to deny service to any Client(s) who repeatedly have a history of cancellations. 

CANCELLATION: If for any reason the Client cancels before the session date, Photographer will keep all monies paid to hold the session date as a cancellation fee. The Client understands and agrees that Cancellation by the Client will not result in a refund of any fees paid on or prior to the date of Cancellation by the Client. All payments will be considered as liquidated damages to Lesanie Images LLC for holding the session date for you. Cancellation must be made in writing and sent in by certified mail or e-mail. Lesanie Images LLC is not responsible for lost, delayed, or undelivered mail or email. If mail or email is sent, confirmation of receipt must be obtained from Lesanie Images LLC. However, if the Client requires to change the session date, Lesanie Images LLC will do its best to accommodate the change and no fee will be charged as long as the new date is available and within 1 month of the original session date. If Lesanie Images LLC is not available for the new date, the original agreement will be canceled and subject to the cancellation policy.

WEATHER: Lesanie Images reserves the exclusive right to reschedule its photography sessions due to weather conditions. Lesanie Images will notify the Client via email 24-48 hours in advance of the sessions if the session needs to be rescheduled due to weather conditions, including but not limited to rain, wind, dust, extreme temperatures, etc. 

LATE ARRIVAL/NO SHOWS: The Client acknowledges that he/she must arrive 10 minutes prior to his/her scheduled photography session time slot so that we will be ready to start shooting at the Client's designated time slot. If the Client is late to his/her session scheduled time slot, time will not be extended or rescheduled. Refunds are not available for sessions cut short or entirely missed due to the Client's late arrival. The Client agrees that if he or she is late to a session, such time will be deducted from the time allotted for the session and the Client’s session will still be for the same scheduled ending time. The Client shall not be compensated for the time deducted from the session due to the late arrival of the Client. This may also reduce the number of edited images if such reduction is deemed necessary at Photographer’s discretion. Client agrees that if he or she is late by more than fifteen (15) minutes, Client will be deemed a no-show, the Photographer will leave and the session fee shall be forfeited.

COOPERATION: Unless otherwise noted, Lesanie Images, its associates, or employees will be the exclusive photographer(s) at the agreed photography session. The clients agree that good faith cooperation and communication between them are important in obtaining a good result. Lesanie Images or the photographer(s) will not be held accountable for not photographing desired portraits if there is no one to assist in identifying these particular details and photographs on the day. Lesanie Images is not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not revealed to Lesanie Images or beyond the photographer(s) control.

EXCLUSIVE PHOTOGRAPHY RIGHTS: In order to provide the best service, no other photography (including videography) may take place during the photography session as this can interfere with lighting, create unnecessary distractions, and shadows, and even ruin a perfect image opportunity. Therefore, it is understood that upon contracting Lesanie Images as your photographer, any and all other photographers and videographers, professional or otherwise, will not be allowed to either interfere or dictate photography during the contracted time.

ARTISTIC STYLE: Client acknowledges that Lesanie Images requires and retains discretion as to how its services shall be provided (e.g. choice of poses, lighting, lenses, etc.) Client is familiar with the photographer’s portfolio and is requesting services with knowledge of the photographer’s style, that their services are of a unique and artistic nature and is constantly evolving therefore images created may be different from images taken in the past.

IMAGE OUTCOME: Lesanie Images does not warrant that it will provide specific images and shall not be liable if key individuals fail to appear or cooperate during the portrait session.

LIMITATIONS ON LIGHT: Lesanie Images is primarily a natural light photographer. Client acknowledges that if any part of the photography session occurs at a time or in a location where there is an absence of natural light, Lesanie Images will have to use artificial light sources, and the images will look different than the natural light images Client have seen in Lesanie Images portfolio. Accordingly, the Client acknowledges that the images shall not be subject to rejection on the basis of taste, aesthetic criteria, or personal appearance.

CULLING, EDITING & RAW IMAGES: Lesanie Images retains complete control over the culling and editing process. After the portrait session, each image is put through a careful selection process where the photographer selects images that meet his/her high standards of quality. Images with eyes closed, unflattering poses, and duplicate images are removed permanently during the culling process. Lesanie Images does not guarantee a minimum number of images in the Client’s final image gallery. Under no circumstance will Lesanie Images release RAW image files. Selected images will be color corrected and lightly edited for presentation. Lesanie Images retains complete control over which images are delivered in colour and which images are delivered in black and white. Any additional Client-requested edits, including but not limited to, the removal of scars, tattoos, or birthmarks, removal of persons or things, body shaping, head swaps, etc. is subject to additional retouching fees of $100 per image.

IMAGES AND COPYRIGHTS: Photographs/images produced by Lesanie Images are protected by Copyright and remain the property of Lesanie Images. Lesanie Images owns all copyrights for any and all images produced in connection with this agreement, including the right to reproduce or publicly display such images, for any personal or commercial purpose, without compensation to Client or notification to Client before use. Lesanie Images also reserves the right to display publicly the names of Client As the author of all images made hereunder, and as provided by law, Client shall retain the copyrights in perpetuity, regardless of possession or ownership, digital files, or any other format of reproduction. Clients will receive high-resolution digital images with printing rights. Upon final payment by Clients, Clients are allowed to display the resulting images for personal use only. Said images may not be digitally altered in any manner without prior written permission of Lesanie Images. Images provided in a private gallery are full-resolution images, and they will be enabled for download from the private gallery. When sharing your photographs publicly, credit shall always be attributed to Lesanie Images.

IRREVOCABLE MODEL RELEASE: By signing any portrait contract with Lesanie Images Client grants Lesanie Images their unlimited permission to license, use, reproduce and distribute images of the Client and/or their property, in any country, at any time, in any media, for any purpose. Such permissible use may include but is not limited to: commercial use, personal use, advertising, trade, exhibition, competition, promotion, marketing, stock photography, product packaging, video, print, publication or editorial work. Client understands and agrees that their images may be altered and modified to the point where they may even be unrecognizable. Images may be combined with other pictures, text or graphics. Names may be changed and used with images. Client will have no right to inspect or approve the final use of images or copy that may accompany it. Client agrees that they have absolutely no right to compensation for use of their images and warrant they will make no claim against Lesanie Images or its assigns for compensation relating to the use of images.

LIMIT OF LIABILITY: Lesanie Images takes the utmost care with respect to exposure, storage, and processing of the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond Lesanie Images' control. If photographic materials are damaged or lost through camera or computer malfunction, the Client agrees that Lesanie Images or the photographer(s) liability will be limited to a retake of the session as soon as possible or a partial refund if a retake cannot be scheduled. If the session fee is refunded (the travel fee will not be refunded), Lesanie Images will have no further obligation.

ACCEPTANCE: Since Lesanie Images provides non-tangible irrevocable goods and services we do not issue refunds once the session is booked. Due to the custom nature of these items, all purchases are non-refundable. By signing this contract and submitting the booking form, the client agrees that the purchase is not refundable. Lesanie Images has a strict policy of no refunds once a transaction has been completed. (i.e. The Client selects photographs, products, digital files, or proofs and completes payment on these products, it is then considered non-refundable.) If the Client receives an incorrect photo that was selected at their ordering, the Client must notify Lesanie Images within 24 hrs of receipt. Lesanie Images will process the correct photo for the Client free of charge. No refunds will be given due to "not liking" the file once received. Failure of Client to comply with these conditions will constitute irrevocable acceptance of the goods by Client.

SALES, REFUND AND CHARGEBACKS: Since Lesanie Images provides non-tangible irrevocable goods and services we do not issue refunds once the session is booked. Lesanie Images has a strict policy of no refunds once a transaction has been completed. (i.e. The Client selects photographs, products, digital files, or proofs, and completes payment on these products, it is then considered non-refundable.) Once a transaction has been completed (i.e., the buyer selected and paid for the photo and then Lesanie Images sent the buyer the correct photographs) it is then considered non-refundable. Due to the nature of custom digital photography and the fact that photographs, once sent, cannot be returned (it is deemed “used”); Lesanie Images has a strict NO REFUNDS POLICY.  If the Client receives an incorrect photo that was selected at their ordering, the Client must notify Lesanie Images within 24 hrs of receipt. Lesanie Images will process the correct photo for the Client free of charge. No refunds will be given due to "not liking" the file once received. Due to the nature of custom photography, all sales are final. Once a product has been purchased by you, no right of cancellation or refund exists under the Consumer Protection (Distance Selling) Regulations 2000 due to the custom and electronic nature of our products. Any refunds shall be at our sole and absolute discretion. You agree that you initiate any chargebacks via your payment provider under no circumstances whatsoever. You agree that any payments made by you for any of our products are final and may not be charged back. We reserve the right to alter any of our prices from time to time.

SAFETY: The Client is responsible for their own safety, the safety of those who accompany them, and the safety of each minor child accompanying them. The Client agrees to retain custody and control of each child at all times during the session to avoid injury. On behalf of themselves and such children, the Client releases Lesanie Images from all claims and liabilities.

COMPLETION SCHEDULE: Lesanie Images will choose the best images from your session. The Client does not take part in the process of choosing which images will be selected for the final gallery. Every image that is chosen will have basic editing done. Images can be expected to be edited and delivered within 2 weeks after the photo shoot date depending on the volume of photographs taken. Delivery will be via a personal online gallery where Clients can download their images from.

ADDITIONAL IMAGES/RAW IMAGES: Lesanie Images does not guarantee any edited images in the Client's final portfolio. Under no circumstance will Lesanie Images release RAW images to the Client. Lesanie Images selects the best representation of the images taken at the event/associated sessions for the Client portfolio, and all other images are deleted during the culling process; therefore, no additional images can or will be released to the Client.

DIGITAL FILES AND ARCHIVAL OF IMAGES: Once purchased digital files will be available to view as an online gallery for 2 weeks after the order is paid in full. This online gallery will be up for 30 days and it is the Client’s sole responsibility to download the files and archive them properly. After 30 days files will be deleted from the online gallery and from Lesanie Images’ drive. Lesanie Images does not provide any type of digital file archival services and is in no way responsible for the loss or damage of files. In the event that a Client needs the gallery to be reposted, and if available, the Client will be responsible for a reposting fee of $150.
